BOOK REVIEW: BUKU SAKU INFORMASI HUKUM BAGI PEREMPUAN KORBAN KEKERASAN DALAM RUMAH TANGGA

Domestic violence is an act of brutality that tends to happen to women and causing physically, sexually, and mentally harms towards women. The well-known cases of domestic violence that people see are only the tip of the iceberg, which there are numerous of cases that do not appear. In Indonesia, domestic violence is considered as a family shame that nobody can know about. Therefore, a lot of victims of domestic violence are still uninformed about the legal matters about this issue, which causing them unable to break the conflict cycle of domestic violence and costing them more agony.

The book ‘Buku Saku Informasi Hukum Bagi Perempuan Korban Kekerasan Dalam Rumah Tangga’ manages to explains the reader about the forms of domestic violence, victim’s rights, and litigation and other legal matters regarding domestic violence.

Based on the article 5 of Undang-Undang Penghapusan Kekerasan Dalam Rumah Tangga, there are a few different forms of domestic violence, that is, physical violence, psychological violence, sexual violence, and negligence. This book also shows the reader the Indonesian laws that protect the rights of the domestic violence’s victim, which stated on the Law of the Elimination of Domestic Violence or Undang-Undang Penghapusan Kekerasan Dalam Rumah Tangga (UU P-KDRT). The laws protect the basic right of victims of domestic violence, the right for protection and safety for the victims, and also the right of victim to gain physical and psychological treatment.

To manage the issue of domestic violence, which considered a crime, the victim can file a lawsuit against the partner or the attacker. The lawsuit is divided into two different scopes: Civil litigation and criminal prosecution. Civil law regulates the rights and duty between parties. Through civil litigation, the victim of domestic violence can claim her rights that have been violated by her husband and demand a divorce. Criminal law regulates social conduct that is threatening and harmful to the people and society, which includes the punishment for whoever violate those laws. In Indonesia, domestic violence is considered as criminal act, which regulated on the article 44-46 UU P-KDRT. By filing a criminal lawsuit the accused can face jail punishment.

This book thoroughly explains about the lawsuit process to help the victim. It explains about the suit, contentious, the requirements, evidence, witnesses, documents, pro Deo (free legal assistance), appeal, investigation, and many other legal related processes in detail. It also gives victim the information that lots of people do not understand or people do not talk about regarding domestic violence. This book is very helpful for every victim to end the domestic violence and to take back the rights of every victim that has been violated by their partner.
